Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your access to and use of Foodtruckin (the “Service”), including the website, dashboard, and related software made available at foodtruckin.co. By creating an account, accessing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. Accounts
You must provide accurate information when you create an account and keep it up to date. You are responsible for safeguarding the credentials you use to access the Service and for any activity under your account. Notify us promptly of any unauthorized access at support@foodtruckin.co.
3. Acceptable use
You will not (a) use the Service to violate any law or third-party right; (b) reverse engineer, scrape, or attempt to access non-public areas of the Service except via the documented APIs; (c) upload content that is unlawful, infringing, deceptive, or harmful to others; (d) interfere with the integrity, performance, or security of the Service; or (e) resell or sublicense the Service without our written permission.
4. Subscriptions and payment
Paid plans are billed in advance on a monthly or annual basis through Stripe. Fees are non-refundable except as required by law or as explicitly stated in these Terms. Your subscription will renew automatically at the end of each billing period unless you cancel through the billing portal. If a payment fails and is not cured within seven (7) days, your public tenant site may be placed into maintenance mode until payment is restored.
5. Your content
You retain all rights to content you upload to the Service (“Your Content”). You grant Foodtruckin a worldwide, non-exclusive, royalty-free license to host, process, display, and transmit Your Content solely to operate, secure, and improve the Service for you. You are responsible for Your Content and for any consents required to publish it.
6. Third-party services
The Service integrates with third-party services (including Google Workspace and Stripe). Your use of those services is governed by their own terms. Foodtruckin is not responsible for the availability or accuracy of third-party services.
7. Termination
You may cancel your subscription at any time from the billing portal. We may suspend or terminate access to the Service for material breach of these Terms, for non-payment, or as required to comply with law. Upon termination, your right to use the Service ends; we will retain data only as long as needed to provide the Service or as required by law.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FOODTRUCKIN'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
10. Changes
We may update these Terms from time to time. Material changes will be announced via email or in-product notice at least seven (7) days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws provisions. The exclusive venue for any dispute is the state or federal courts located in Virginia.
12. Operator and contact
